Article 1: General Provisions

The e-commerce website of Micale, a BV with registered office at Baron van Ertbornstraat 4 A2, 2630 Aartselaar, VAT BE 0795.863.917, RPR Antwerp, (hereinafter “Pastine”) offers its customers the possibility to purchase products from its webshop online.

These General Terms and Conditions (“Terms”) apply to every order placed by a visitor to this e-commerce website (“Customer”). By placing an order via Pastine’s webshop, the Customer explicitly accepts these Terms, thereby agreeing to their applicability, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, unless expressly accepted in advance, in writing, by Pastine.

Article 2: Price

All prices listed are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

Deliveries above €50,00 are free of charge. The shipping cost for goods under this amount is specified separately at checkout.

The price quotation applies exclusively to the articles as literally described. The accompanying photos are intended for decorative purposes and may contain elements not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Pastine. Pastine is only bound by a best-efforts obligation with regard to the accuracy and completeness of the offered information. Pastine cannot be held liable in case of manifest material errors, misprints, or typographical errors.

When the Customer has specific questions about, for example, sizes, color, availability, delivery time, or delivery method, we ask the Customer to contact our customer service in advance.

The offer is always valid while stocks last and may be modified or withdrawn at any time by Pastine. Pastine cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be expressly stated in the offer.

Article 4: Online Purchases

To purchase a product, add it to your shopping cart. Then enter your contact and billing information. Next, choose your delivery method. In the final step, you will receive an overview page, accept our general terms and conditions, and confirm your payment by pressing the order button. After completing these steps, your order is final.

Your order is complete and the agreement final once we confirm your order by email and once we have received approval from the card issuer for your payment transaction with credit or debit cards. We accept Bancontact, Visa, Mastercard, Paypal, and you can pay online via several online banking apps (Belfius, KBC, ING).

Pastine reserves the right to refuse an order in case of a serious shortcoming on the part of the Customer concerning orders in which the Customer is involved.

Article 5: Delivery and Performance of the Agreement

Items ordered via this webshop are only delivered within the Benelux.

Delivery is carried out by Bpost.

Unless otherwise agreed or explicitly stated, the goods will be delivered to the Customer’s place of residence within 1 to 3 days after receipt of the order.

Any visible damage and/or qualitative defect of an article or any other shortcoming in the delivery must be reported by the Customer to Pastine immediately.

The risk of loss or damage passes to the Customer from the moment he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk passes to the Customer upon delivery to the carrier if the carrier was instructed by the Customer to transport the goods and this choice was not offered by Pastine.

Article 6: Retention of Title

The delivered articles remain the exclusive property of Pastine until full payment has been made by the Customer.

The Customer undertakes, if necessary, to point out Pastine’s retention of title to third parties, for example to anyone who might seize the articles not yet fully paid for.

Article 7: Right of Withdrawal

The provisions of this article apply only to Customers who purchase items online from Pastine in their capacity as consumers.

The Customer has the right to withdraw from the agreement within 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the goods.

To exercise the right of withdrawal, the Customer must notify Pastine (Baron van Ertbornstraat 4, 2630 Aartselaar, +32 3 877 57 87, hello@pastine.store) by means of an unambiguous statement (e.g., in writing by post, fax, or email) of his decision to withdraw from the agreement. The Customer may use the attached model withdrawal form, but is not obliged to do so.

To comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Pastine without delay, but in any case not later than 14 calendar days after the day on which he communicated his decision to withdraw. The Customer is on time if he sends back the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

The Customer is requested to return the articles in their original condition and packaging, with all accessories and instructions included.

All returned articles will be carefully examined. The principle is that the consumer may only inspect the article as he would be allowed to do in a shop. Returned articles may be tried on, but not used. If an item has decreased in value due to the Customer’s use, this will be charged to the Customer.

If the Customer withdraws from the agreement, Pastine will refund all payments received from the Customer, including the standard delivery costs, within a maximum of 14 calendar days after Pastine has been informed of the Customer’s decision to withdraw. Pastine may wait with the refund until it has received all the goods back, or until the Customer has supplied proof of return, whichever is earlier.

Any additional costs resulting from the Customer’s choice of a delivery method other than the cheapest standard delivery offered by Pastine will not be refunded.

Pastine will refund the Customer using the same payment method as the Customer used in the original transaction, unless expressly agreed otherwise; in any case, no fees will be charged to the Customer for such refund.

Article 8: Warranty

Under the law of 21 September 2004 concerning the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging.

For items purchased online and delivered to the Customer’s home, the Customer must contact Pastine customer service and return the article at his own expense.

In case of a defect, the Customer must notify Pastine as soon as possible. In any case, each defect must be reported within 2 months of its discovery. After that, any right to repair or replacement lapses.

The (commercial and/or legal) warranty never applies to defects arising from accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to follow the instructions for use or manual, adjustments or modifications to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.

Article 10: Sanctions for Non-Payment

Without prejudice to the exercise of other rights held by Pastine, in case of non-payment or late payment, the Customer will, by law and without notice, owe an interest of 10% per year on the unpaid amount from the date of default. In addition, the Customer will owe, by law and without notice, a fixed compensation of 10% on the amount in question, with a minimum of €25,00 per invoice.

Without prejudice to the foregoing, Pastine reserves the right to take back the articles that have not (fully) been paid for.

Article 11: Privacy

The data controller, Pastine, respects the Belgian law of 8 December 1992 concerning the protection of privacy in the processing of personal data.

The personal data you provide will only be used for the following purposes: processing the order, sending newsletters, advertising, and/or marketing purposes.

You have a legal right to access and correct your personal data. With proof of identity (copy of ID card), you can obtain a written communication of your personal data free of charge by means of a written, dated, and signed request to Pastine, Baron van Ertbornstraat 4, 2630 Aartselaar – hello@pastine.store. If necessary, you can also ask to correct the data that is incorrect, incomplete, or irrelevant.

In case of use of data for direct marketing: You may oppose, free of charge, the use of your data for direct marketing. You can always contact Pastine, Baron van Ertbornstraat 4, 2630 Aartselaar, hello@pastine.store.

We treat your data as confidential information and will not pass it on, rent, or sell it to third parties.

The customer is responsible for keeping his login details confidential and for the use of his password. Your password is stored encrypted, so Pastine has no access to it.

Pastine keeps anonymous online visitor statistics to see which pages of the website are visited to what extent.

Article 12: Use of Cookies

During a visit to the site, 'cookies' may be placed on the hard drive of your computer. A cookie is a text file placed by a website server in the browser of your computer or mobile device when you consult a website. Cookies cannot be used to identify persons, a cookie can only identify a machine.

Article 13: Validity – Non-Waiver

If any provision of these Terms is declared invalid, illegal, or null, this shall in no way affect the validity, legality, and applicability of the other provisions.

Failure at any time by Pastine to enforce any of the rights listed in these Terms, or to exercise any right thereof, will never be considered as a waiver of such provision and will never affect the validity of these rights.

Article 14: Amendment of Terms

These Terms are supplemented by other terms explicitly referred to, and the general terms and conditions of Pastine. In case of contradiction, these Terms shall prevail.

Article 15: Proof

The Customer accepts that electronic communications and backups can serve as proof.

Article 16: Applicable Law – Disputes

Belgian law applies, with the exception of the provisions of private international law on applicable law.

The courts of the Customer’s place of residence are competent in case of judicial disputes. The Customer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
